By accessing and using ListoCar, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from using our services.

1. Definitions and Interpretation

  • "Agreement" means these Terms and Conditions, including any amendments made hereto from time to time.
  • "Platform" means the website ListoCar and all associated services.
  • "User" means any individual or entity accessing or using the Platform.

2. Scope of Services

2.1 The Service Provider offers the following services through the Platform:

  • Vehicle History Reports (HPI Check)
  • VIN Decoding Services
  • Fuel Station and Charging Point Locator
  • HPI Check
  • Crit'Air Stickers
  • Non-Pledge Certificate
  • Irish Automotive Market Data Access

2.2 The Service Provider reserves the right to modify, suspend, or discontinue any aspect of the services at its sole discretion, with or without notice.

2.3 I understand that services accessible with a trial offer at €1.05 explicitly subscribe to a monthly subscription if cancellation is not made before the end of the trial period.

2.4 ListoCar offers vehicle verification and calculation services tailored for the UK and Ireland. The UK HPI Check starts at €21.95 for a basic report, with additional options priced at €21.95 for a full HPI check, €26.40 for a bundle of 3, or €35.20 for a bundle of 5 complete reports. The Ireland VRT Calculator begins at €8.25 for the standard calculation, and the same full HPI check bundles are available for €21.95, €26.40, or €35.20. Additionally, a monthly subscription is available with a 2-day trial at €1.05, followed by €41.69 per month, including unlimited access to the VIN Decoder, Car Buying Guide, gas and electric station finders, 2 Crit'Air stickers per month, 3 Non-Pledge Certificates per month, a personalised itinerary planner, and priority support.

3. User Registration and Account Security

3.1 Account Creation: Users must provide accurate, current, and complete information during the registration process.

3.2 Account Security: Users are solely responsible for:

  • Maintaining the confidentiality of their account credentials
  • Restricting access to their account
  • Accepting responsibility for all activities occurring under their account

3.3 Security Breach: Users must immediately notify the Service Provider of any unauthorized use or security breach of their account.

4. Intellectual Property Rights

4.1 Ownership: All intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and patents, in the Platform and its content are owned by or licensed to the Service Provider.

4.2 Restricted Use: Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

4.3 Prohibited Actions: Users shall not:

  • Copy, modify, or create derivative works of the Platform or its content
  • Reverse engineer, decompile, or disassemble any portion of the Platform
  • Remove any copyright, trademark, or other proprietary notices
  • Use any automated systems or software to extract data from the Platform

5. Data Protection and Privacy

5.1 GDPR Compliance: The Service Provider processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws.

5.2 Data Processing: By using the Platform, Users consent to the collection, processing, and storage of their personal data as described in our Privacy Policy.

5.3 Data Subject Rights: Users may exercise their rights under GDPR, including:

  • Right of access
  • Right to rectification
  • Right to erasure
  • Right to data portability
  • Right to object to processing

6. Limitation of Liability

6.1 Disclaimer: The Platform is provided "as is" and "as available" without any warranties of any kind, either express or implied.

6.2 Limitation: To the fullest extent permitted by law, the Service Provider shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or technical issues
  • Actions or omissions of third parties

6.3 Cap on Liability: In any event, the Service Provider's total liability shall not exceed the amount paid by the User for the services in the twelve months preceding the claim.

7. Dispute Resolution

7.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland.

7.2 Jurisdiction: Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts.

7.3 Alternative Dispute Resolution: Prior to initiating legal proceedings, parties agree to attempt to resolve any disputes through good-faith negotiations.

8. Force Majeure

The Service Provider shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond its reasonable control, including but not limited to:

  • Acts of God or natural disasters
  • Governmental actions or regulations
  • War, civil unrest, or terrorist activities
  • Network or telecommunications failures
  • Cyber attacks or security breaches

9. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms and Conditions unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

10. Amendments

10.1 The Service Provider reserves the right to modify these Terms and Conditions at any time.

10.2 Users will be notified of any material changes through:

  • Email notifications
  • Platform announcements
  • Updates to the "Last Updated" date

10.3 Continued use of the Platform following any modifications constitutes acceptance of the updated Terms and Conditions. The CGUs are subject to Irish law.

11. Withdrawal and Refund Policy

In accordance with the applicable provisions of Irish consumer law, the Customer has a legal right of withdrawal within fourteen (14) calendar days from the date of conclusion of the contract, provided that the service has not yet been delivered. In such case, a full refund of any amounts paid will be issued within a reasonable period of time.

However, the Customer expressly acknowledges that once the service has commenced or has been fully performed before the expiry of the withdrawal period, the right of withdrawal is lost and no refund, whether full or partial, shall be granted.
